"Wills, V1/2, 1772-1896; Berkeley Co., VA; FHL# 831,169, WB1, 1772-1788; p435-6; DOW: 11 Aug 1786; DOProbate: 20 Sep 1786; Will of Jacob HAM;
In The name of God amen I Jacob HAM of Berkeley County and State of Virginia being in sound mind but weak in body do hereby make this my last Will and Testament in manner following, revoking all former Wills by me made,
First I leave my Soul to God who gave it me in hopes of Mercy through the Merits and mediation of our blessed Lord and Savior Jesus Christ and my body to the Earth to be buried at the discretion of my Executor;
Item I leave and bequeath to my Dear wife Barbara HAM one Cow She taking her choice of all my cattle to be fed by my Son Jacob HAM also Such part of my household furniture as She Shall chose and Seventeen Bushels Wheat and five pounds Pennsylvania Currency and one humndred Weight of Meat to be paid her by the year and also a Room upStairs in my house;
Item I leave and bequeath unto my Son Jacob HAM all my land which I bought of John BRISCOE and where I now live he paying to each of my Sons Nicholas HAM, Michael HAM and John HAM Seventy five pounds Pennsylvania Currency each the yearly payment of Six pounds ten Shillings [p436] to each of them till the whole of Seventy five pounds is paid without interest,
Item I leave and bequeath to my Daughtrer Catherine POTTS the Sum of twenty pounds Pennsylvania Currency to be Paid her by the yearly payment of five pounds till the whole is paid,
and as to personal estate my will is that my son Michael HAM have his choice of all my hares and my son John HAM his second choice each to take one and the remainder of my personal Estate to be Sold and I order that all my Just Debts and funeral expenses be paid out of the money arising from said Sale and the remainder my Desire is to be Divided between my wife and my Sons Jacob, Michael ane John HAM allowing my Son Michael HAM Ten pounds Pennsylvanis Currency more than the rest in consideration of his having worked with me when of age
and do hereby appoint my Son Jacob HAM my whole and Sole Executor of this my last will and Testamemt. Signed Sealed published and declared by the Testator to be his last Will and testament in the presence of us this 12th Day of Aug 1786; L.S. Gedion SWIFT, L.S. Thomas HART Junr, L.S. Jacob MILLER;
In court continued and held for Berkeley County, the 20th Day of September 1786 This Last Will and Testament of Jacob HAM decd was presented in Court by Jacob HAM the Executor therein named who made oath thereto according to Law and the same being proved by the oaths of Jacob MILLER and Thomas HART Jur. Witnesses thereto and ordered to be recorded, and on the motion of the Said Executor who entered into Bond with Jacob MILLER his Security in the penalty of five hundred Pounds conditioned for his true and faithful administration of the Said Estate Certificate is granted him for obtaining a probate Thereof on Due form of Law;
